September 4, 2023 "With just about one week to go before oral arguments in my epic quarantine lawsuit against despotic Governor Hochul and her Ministry of Tyranny, (oops sorry, I did it again… I meant to write “Department of Heath”, not “Ministry of Tyranny” - silly me), there’s a lot of buzz happening about the showdown. Let me clarify and say that this is Round #2. I already won Round #1 last summer. But, since power-hungry politicians and Executive Branch bureaucrats don’t like to stay in their lane and obey the Constitution, they are appealing my victory, and so we’re now duking it out in Round #2. Oral arguments for the appeal are September 13th at 10:00am EST, at the courthouse in Rochester located at 50 East Avenue.
"You can get more details about the case (Borrello v. Hochul), the timeline, etc. in my article from last week, but in short, last year on behalf of a group of New York State legislators, Senator George Borrello, Assemblyman Chris Tague, and Congressman Mike Lawler, together with a citizens’ group called Uniting NYS, I sued Hochul over her authoritarian “Isolation and Quarantine Procedures” rule, and we won! The trial court struck down the rule as unconstitutional on multiple levels (violative of NYS law, breach of the sacred Separation of Powers doctrine, and zero due process protections). However, since totalitarians don’t give up power very easily, Hochul and her fellow defendants (the NYS Department of Health, the Commissioner of Health, and the Health Planning Council) are appealing. They want to overturn the lower court’s decision so they can get back their horrendous rule.
